What Bankruptcy Records Contain

Bankruptcy records for North Bethesda cases are federal public documents. They show a full financial picture of the debtor at the time of filing. Full Social Security numbers are redacted, but most of the file is open to anyone who searches.

The petition is the first and most basic document. It names the debtor, lists their current address, states the chapter they filed under, and says whether the filing is voluntary. Attached schedules are the core of the financial disclosure. One schedule lists all real property. Another covers personal property like vehicles, bank accounts, and household goods. More schedules show all debts by creditor with amounts and whether they are secured or unsecured. Income and expense schedules show monthly cash flow. These documents together give a clear picture of why the debtor sought relief.

The statement of financial affairs covers recent transactions that the court wants to know about. This includes payments to creditors in the 90 days before filing, transfers of property in the last two years, any lawsuits filed by or against the debtor, and business interests. Chapter 7 files have a trustee report on whether assets are available for creditors. Most North Bethesda Chapter 7 cases are no-asset, meaning unsecured debts are erased with no payment. Chapter 13 files contain the repayment plan, showing how the debtor will pay back some debts over three to five years. Both chapter types end with either a discharge order, which releases the debtor from covered debts, or a dismissal order, which ends the case without discharge. The discharge order is what most creditors and lenders look for when checking a person's bankruptcy history.

Bankruptcy Filing Fees

Federal court filing fees are the same across all of Maryland. North Bethesda residents pay the same rates as filers anywhere else in the state.

  • Chapter 7 (liquidation): $338
  • Chapter 13 (repayment plan): $313
  • Chapter 11 (business reorganization): $1,738

Individual filers can ask to pay in installments. The court allows up to four payments for Chapter 7 and Chapter 13 cases. All payments must be made before the court issues the discharge. Filers whose income is below 150% of the federal poverty line may apply for a complete fee waiver for Chapter 7 cases. The court reviews each request separately. Greenbelt does not take cash, so bring a card or pay online through pay.gov before you file in person. Record access fees are $0.50 per page for plain copies and $5.00 plus $0.50 per page for certified copies.
