What Silver Spring Bankruptcy Records Include

Bankruptcy case files are public records. Most documents are open to anyone through PACER or at the courthouse. Courts seal specific records only in rare cases, usually on a formal motion showing good cause.

Every Silver Spring bankruptcy case file starts with the petition. The petition names the debtor, gives the address, and states which chapter was filed. It is accompanied by required schedules: assets and property (Schedule A/B), secured and unsecured debts (Schedules D-H), income (Schedule I), and monthly expenses (Schedule J). For Chapter 7 cases, a means test form is also in the file. The statement of financial affairs covers the debtor's financial history for the past few years.

More documents follow as the case moves forward. Creditors submit proofs of claim. The trustee files reports and may report on assets available for distribution. Any motions by either side, court orders, and hearing notices are docketed. In a Chapter 13 case, the repayment plan and any modifications to it are part of the public record. The discharge order or dismissal order ends the case and goes into the file as well. All of this is accessible through PACER.

Federal rules require that Social Security Numbers be masked in public filings. Courts may also seal exhibits containing sensitive personal or financial data when a party asks. But the main case documents, creditor lists, schedules, and orders are nearly always open to the public.

Bankruptcy Filing Fees for Silver Spring Residents

Filing fees are set by the federal court system. They are the same for all Maryland filers, regardless of city or county. Silver Spring residents pay the same fees as anyone else filing in the District of Maryland.

  • Chapter 7: $338.00
  • Chapter 13: $313.00
  • Chapter 11: $1,738.00

If the Chapter 7 fee is a barrier, you can apply to pay in installments or apply for a full fee waiver. The waiver requires income below 150% of the federal poverty guideline and is limited to Chapter 7. An installment plan allows up to four payments. You must finish paying before the court can grant a discharge. Chapter 13 and Chapter 11 do not have waiver options, but the installment plan may still be available for Chapter 13 in limited circumstances.

Since December 10, 2025, the Greenbelt Division does not accept cash. Silver Spring filers need to use pay.gov, mail a check to Baltimore, or go to the Baltimore intake window to pay by cash or other methods. Do not bring cash to the Greenbelt courthouse expecting to pay there. The Baltimore Division intake is at 101 W. Lombard Street, Suite 8530, Baltimore, MD 21201, phone (410) 962-4295.
